The infamous Supreme Court decision that was made on January 22, 1973, in the Roe v Wade and Doe v Bolton cases are only the beginning in the legality of abortion. There are numerous factors that have been put into the equation of what the abortion law really means. Who can legally perform an abortion? Will insurance coverage pay for an abortion? Do minors need parental consent? What types of counseling are required, and is there a waiting period after counseling? Because of this, laws vary from state to state when defining what is legal.
There are other laws that seem to be just as controversial. For instance, if a woman becomes pregnant, she can have a paternity test done to prove through DNA who the father is and hold him responsible for child support. However, if she chooses to have an abortion, he has no legal right to stop her. Click here for an overview of the state abortion laws.
Unfortunately, abortion laws of this country are vague even in the opinions of the Supreme Court Justices. In an article titled, "Some Thoughts on Autonomy and Equality in Relationship to Roe v. Wade," Justice Ginsburg states, "The conflict is not simply one between a fetus' interest and a woman's interest… Also in the balance is a woman's autonomous charge of her full life's course, her ability to stand in relation to men, society and to stay as an independent, self-sustaining equal citizen. As long as the government paid for childbirth, the argument proceeded, public funding could not be denied for abortion, often a safer and always a far less expensive course short and long term. By paying for childbirth but not abortion, the government increased spending and intruded upon or steered a choice Roe had ranked as a woman's fundamental right." The legal battles over abortion continue to grow and are more than we could ever put on this site. The one thing they all seem to have in common is the decision to protect a child in the womb is only as safe as when the mother agrees to keep the child safe.
